How long is a Macau trade mark valid for?

Unlike many other jurisdictions, Macau’s trademark validity period is only seven years. Macau trademarks need to be renewed prior to six months before their expiration.

Three years. If a trademark has been in continual disuse for at least three years, then any party can file a claim to revoke that trademark.

Unfortunately not. Trademark applications in Macau must be filed in Portuguese or Chinese, even if they are being filed by legal persons not established in Macau.

The list of what can’t be registered as a trademark in Macau is incredibly extensive. Interestingly, Macau forbids the registration of colors as a trademark unless those colors are arranged in a distinctly unique way. Following is just a sample of some of the things that cannot be registered as trademarks.

  • Any marks containing flags or coats of arms without consent of the body to which that flag belongs.
  • Any marks containing official seals or stamps of guarantee.
  • Marks containing the emblem or name of the Red Cross.
  • Marks containing business names or marks of other businesses.
